I just updated an installation to build 314. The Agent installer did not stop the service, but rather attempted to replace the files while the service was running.
Stopping the service manually and telling the installer to retry enabled to continue with the installation.

This issue is still recreated with 1.0.0.423.
This should be fixed in build 461, the problem looks to be cause by an agent shutdown bug, the agent wasn’t shutting down cleanly and then didn’t restart. You might still see the issue with build 461 but in future builds this issue should be resolved, if you still see it in the build after 461 please let us know.
